Can you have an exit stair in the setback if it is 'open'?
I am thinking specifically of a stair from a basement garage up to grade.

I can't answer this question with any confidence but here are my assumptions.
Keep in mind the answer might also depend on where in the city the project is located.
An open stair is not usually counted towards FAR or GFA. However, if you have an open stair tower it is still a structure and likely not allowed in a required setback.
If your stair is not a tower and only goes from the underground garage to grade, I think it might be allowed.
You will have to ask a Project Manager or hope someone who knows more about this than me will post a reply.

In a Setback?
Verify the location of your stair on your property. If it is within a setback there may be height restrictions - especially if it is a front yard. These usually 'bite' you on a stair down to grade from an elevated level/floor. But, be carefull about the height of required hand and/or guardrails. In setbacks the height of strcutures is sometimes restricted to 3' tall. For example: If you are a commercial or multi-family project, and a guardrail is required, it will need to be 42" high.
